This companion to an earlier report--entitled "Regulating Adult Entertainment: A Review of the Live Adult Entertainment Industry in Queensland"--describes the regulation of adult entertainment in each of the six States and two Territories in Australia.
Abstract
The aim of this report is to provide information that will assist Queensland policymakers, members of the adult entertainment industry, and the general public in their consideration of the recommendations of the earlier report. The current report indicates that every jurisdiction in Australia, except Tasmania, regulates adult entertainment as an adjunct to its liquor licensing system. Criminal law and regulatory systems dictate the type of adult entertainment allowed in each jurisdiction. Most jurisdictions permit adult entertainment that involves women in lingerie and topless waitresses; however, few jurisdictions allow explicit sexual acts between performers, or do so only under specified restrictions. Six jurisdictions have a regulatory system for adult entertainment, with Queensland having the most comprehensive system. In each Australian jurisdiction, one or more of the following criminal offenses may apply to adult entertainment: indecency, obscenity, and prostitution. A primary concern of all jurisdictions is to protect minors from viewing or performing in adult entertainment. All jurisdictions prohibit minors from patronizing liquor-licensed premises. The reforms proposed by Queensland's Crime and Misconduct Commission in its earlier report on the adult entertainment industry would make Queensland the only Australian jurisdiction to regulate adult entertainment in premises both with and without a liquor license. The reforms contain detailed specifications for what is and is not permissible in the whole of the adult entertainment industry. The proposed reforms are included in this report. 4 tables
