PRESENTATION OF A STUDY OF THE CONSEQUENCES OF THE INTRODUCTION OF THE SIX-MAN JURY INTO THE FEDERAL DISTRICT COURTS.
Abstract
CIVIL CASES IN WHICH A JURY TRIAL WAS CONDUCTED AND WHICH WERE COMPLETED BETWEEN JULY 1970 AND JUNE 1972 IN THE FEDERAL DISTRICT COURTS OF MAINE, MASSACHUSETTS, NEW HAMPSHIRE, AND PHODE ISLAND ARE INCLUDED IN THE SURVEY. TABLES ILLUSTRATE VARIABLES USED TO ASSESS THE BEHAVIOR OF SIX AND TWELVE MAN JURIES IN THE 252 CASES. THE AUTHORS CONCLUDED THAT THE TIME SAVED BY JURIES OF SIX WAS MODEST AND THAT SIX MEMBER JURIES WERE MUCH MORE LIKELY THAN JURIES OF TWELVE TO FIND FOR THE PLAINTIFF.
