A BRIEF WHICH IS INTENDED TO OUTLINE THE FAILURE OF THE PURPOSE AND CONCEPTS OF THE CRIMINAL LAW OF CANADA AS IT RELATES TO THE INDIAN AND NATIVE CRIMINAL OFFENDERS IN ITS APPLICATION.
Abstract
IN RESPONSE TO THE DISPROPORTIONATE NUMBER OF INDIANS INCARCERATED FOR MINOR OFFENSES, THE BRIEF RECOMMENDS THE ESTABLISHMENT OF NATIVE COURTS ON THE RESERVES TO HANDLE SUCH OFFENSES. NATIVE POLICE FORCES ARE RECOMMENDED FOR LAW ENFORCEMENT ON THE RESERVES. THE NEED FOR CULTURAL ORIENTATION IN LEGAL AID, PROBATION, PAROLE, AND COMMUNITY RE-ENTRY PROGRAMS IS ALSO STRESSED.
