AN EXAMINATION OF THE ROLE OF CANADIAN CRIMINAL LAW IN THE CONFLICT BETWEEN THE SPECIALIZED INTERESTS OF GROUPS, THE MORE GENERAL INTERESTS OF SOCIETY, AND THE INTERESTS OF INDIVIDUALS.
Abstract
THE POINT OF FOCUS IS THE CORPORATION, ALTHOUGH DISCUSSION IS NOT RESTRICTED TO THE NARROW ISSUE OF CORPORATE RESPONSIBILITY. EXISTING LAW GOVERNING CRIMINAL RESPONSIBILITY FOR CORPORATE ACTIONS IS DISCUSSED, AS ARE DISTINCTIONS BETWEEN REAL CRIMES AND REGULATORY OFFENSES. THE INTERRELATIONSHIP BETWEEN INDIVIDUAL AND CORPORATE RESPONSIBILITY IS EXPLORED, AND SANCTIONING OBJECTIVES AND PROCEDURES ARE EXAMINED. EMPHASIS IS ON RESTRAINT IN THE USE OF CRIMINAL LAW LEADING TO A NEED FOR INCREASED EMPHASIS ON NON-CRIMINAL MEANS OF ENSURING CORPORATE RESPONSIBILITY. --IN ENGLISH AND FRENCH
