THIS WORKING PAPER PROVIDES AN HISTORICAL PERSPECTIVE ON JUVENILE STATUS OFFENSES, AND PRESENTS AND ANALYZES SEVERAL OPPOSING VIEWS ON THE JURISDICTION OF JUVENILE COURTS OVER PERSONS IN NEED OF SUPERVISION (PINS).
Abstract
A COMPREHENSIVE CHART IS PROVIDED WHICH SUMMARIZES THE POSITIONS TAKEN BY ORGANIZATIONS AND INDIVIDUALS CONCERNED WITH JUVENILE STATUS OFFENDERS AND THE COURT. THE CHART LISTS THE NAME OF EACH GROUP, THE POSITION OF EACH GROUP, THE RATIONALE BEHIND THE POSITION, AND ANY RECOMMENDATIONS FOR CHANGES IN PROCEDURES AND SERVICES. THE CHART INCLUDES COURT REFORM GROUPS, FEDERAL COMMISSIONS AND AGENCIES, STATE COMMISSIONS AND AGENCIES, JUDICIAL ORGANIZATIONS. LEGAL DEFENSE GROUPS, JUDGES, VOLUNTARY CHILD CARE AGENCIES, AND CIVIC ORGANIZATIONS. IN ANALYZING THE POSITIONS OF THESE GROUPS, THE AUTHOR REVIEWS THE ARGUMENTS FOR AND AGAINST THE JUVENILE COURT'S JURISDICTION OVER JUVENILE STATUS OFFENDERS. THE FOLLOWING ISSUES ARE RAISED IN THIS ANALYSIS: THEORIES ON DELINQUENCY, PINS' CHARACTERISTICS AND BEHAVIOR PROBLEMS, THE FAILURE OF THE JUVENILE COURT, THE LEGAL ISSUES RAISED BY PINS' JURISDICTION, AND THE IMPACT OF PINS' JURISDICTION ON SERVICES.
