THIS NOTE EXPLORES THE NATURE OF POLYGRAPHY AND THE APPROPRIATENESS OF THE STANDARDS USED TO EVALUATE ITS EVIDENTIARY USE IN COURTS.
Abstract
THE AUTHOR FIRST EXAMINES THE GENERAL ACCEPTANCE STANDARD PROMULGATED IN FRYE V US (1923) AND COMPARES IT WITH THE RELEVANCY STANDARD IN THE FEDERAL RULES OF EVIDENCE. THE PREJUDICIAL EFFECT AND ASPECTS OF POLYGRAPHIC EVIDENCE ARE EXPLORED AND THE QUALIFIED ADMISSION OF POLYGRAPH EVIDENCE IN SOME COURTS IS EXAMINED. THE AUTHOR CONCLUDES THAT CAUTIOUS STEPS BY THE JUDICIARY TOWARD INTEGRATING POLYGRAPHY WITH THE LAW ARE IN ORDER....EB
