THE COOPERATION BETWEEN PROSECUTION AND POLICE THE FIELD OF ECONOMIC CRIME, THEIR PROBLEMS, AND SUGGESTED SOLUTIONS ARE ANALYZED IN THIS PANEL DISCUSSION.
Abstract
AN INTRODUCTORY PAPER SUMMARIZES THE RELATIONSHIP BETWEEN PROSECUTION AND POLICE WHICH, FOR MANY REASONS, IS UNEASY AND TENSE. IN THE AREA OF ECONOMIC CRIME, THE MAIN PROBLEMS CONCERN QUESTIONS OF ORGANIZATION (E.G., LACK OF POLICE PERSONNEL TRAINED TO DEAL WITH ECONOMIC CRIME), LEADERSHIP (THE RIGHT OF THE PROSECUTION TO GIVE DIRECT ORDERS TO THE POLICE), COMMUNICATION (INSUFFICIENT EXCHANGE OF INFORMATION CONCERNING THE STATE OF AN INVESTIGATION), AND SPHERES OF RESPONSIBILITY (EACH AGENCY'S POWER TO INVESTIGATE). SUGGESTIONS FOR IMPROVING THE COLLABORATION INCLUDE THE CREATION OF AN EXTENSIVE SYSTEM OF COMMUNICATIONS, THE TRAINING OF QUALIFIED POLICE PERSONNEL, AND A MORE THOROUGH DIFFERENTIATION IN THE RESPONSIBILITIES OF EACH AGENCY. IN COMMENTING ON EACH OF THE POINTS, A PANEL CONSISTING OF MEMBERS OF THE POLICE AND THE JUDICIAL SYSTEM MAKE THE FOLLOWING SUGGESTIONS. EACH AGENCY'S SPHERE OF RESPONSIBILITY NEEDS TO BE REDETERMINED TO ASSURE MORE EFFICIENT INVESTIGATIVE EFFORTS. THE FLOW OF INFORMATION BETWEEN BOTH AGENCIES MUST BE IMPROVED; TO THIS PURPOSE, THE EXISTING NETWORK OF POLICE COMMUNICATION MIGHT BE EXTENDED. IN THE INTEREST OF EFFICIENCY, A FURTHER INCREASE IN ADMINISTRATIVE WORK SHOULD BE AVOIDED. FINALLY, BOTH AGENCIES SHOULD ATTEMPT TO ADJUST THEIR INTERNAL ORGANIZATIONAL STRUCTURE TO SUIT EACH OTHER'S REQUIREMENTS. A SHORT BIBLIOGRAPHY AND FOOTNOTES ACCOMPANY THE PAPER. --IN GERMAN. (SAJ)
