THIS IS A PROCEDURES HANDBOOK INTENDED FOR PRESENT AND FUTURE JUSTICES ELECTED TO THE ENGLISH JUVENILE COURT PANEL. HEARINGS, ORDERS, CARE PROCEDURES, AND APPEALS ARE COVERED.
Abstract
AN EXAMINATION OF THE ENGLISH JUVENILE COURT PROCESS IS UNDERTAKEN. ADVICE REGARDING CONSULTATIONS BEFORE SEEKING CARE OR CRIMINAL PROCEEDINGS IS PROVIDED. THE PROCESS OF APPOINTMENT TO THE JUVENILE COURT PANEL IS REVIEWED WITH ATTENTION TO ASPECTS OF TRAINING FOR SERVICE IN THE JUVENILE COURT. THE SELECTION OF A PANEL CHAIRMAN, AND THE CHAIRMAN'S ROLE IN RELATIONSHIP TO THE CLERK, WELFARE SERVICES, DEFENDANTS AND THEIR PARENTS, AND COLLEAGUES ON THE PANEL ARE REVIEWED, AS IS THE CHAIRMAN'S ROLE DURING JUVENILE HEARINGS AND WITH REGARD TO THE ANNOUNCEMENT OF DECISIONS. THE LAYOUT AND ATMOSPHERE OF THE JUVENILE COURTROOM IS DESCRIBED. THE ROLE OF THE PARENT DURING COURT PROCEEDINGS IS OUTLINED, THE RIGHT TO AND MANNER OF LEGAL REPRESENTATION IS REVIEWED. THE JUVENILE COURT HEARING PROCESS FOR CRIMINAL CHARGES IS OVERVIEWED; ASPECTS OF THE APPLICATION OF THE AGE OF CRIMINAL RESPONSIBILITY, QUESTIONS OF BAIL, THE FORMAT FOR HEARING OF THE CHARGE, THE TIMING OF REPORTS OF PRIOR POLICE CAUTIONS, AND THE PROCEDURE FOR RECEIVING THESE AND OTHER PRECONVICTION AND POSTCONVICTION REPORTS ARE DISCUSSED. THE VARIOUS ORDERS AVAILABLE TO JUVENILE PANELS -- FINES, ATTENDANCE CENTER ORDERS, DETENTION CENTER ORDERS, COMMITTAL TO CROWN COURT FOR BORSTAL TRAINING, DEFERMENT OF SENTENCE, ABSOLUTE OR CONDITIONAL DISCHARGES, AND SUPERVISION, CARE, GUARDIAN OR HOSPITAL ORDERS -- ARE REVIEWED. THE PROCEDURE BY WHICH AN ORDER IS DECIDED UPON AFTER A FINDING OF GUILTY IS ALSO REVIEWED. CARE PROCEEDINGS IN JUVENILE COURTS ARE DESCRIBED; THE COMMENCEMENT OF SUCH PROCEEDINGS AND ASPECTS OF EVIDENCE, PROOF, AND THE POSSIBLE EXCLUSION OF THE PARENTS OR THE JUVENILE DURING PORTIONS OF THE HEARING PROCESS ARE DISCUSSED. THE VARIATION OR DISCHARGE OF A CARE ORDER AND THE ROLE OF SOCIAL WORKERS, DOCTORS, AND OTHER PROFESSIONAL PEOPLE AS WITNESSES ARE REVIEWED. THE LIMITED AVAILABILITY OF CHOICE OF ORDERS IN CARE CASES IS DISCUSSED. SOURCES AND PROCESSES FOR APPEAL OF JUVENILE COURT DECISIONS ARE NOTED. APPENDIXES PROVIDE SUGGESTED PRECEDENTS FOR THE GUIDANCE OF THE CHAIRMAN OF THE JUVENILE COURT, PROVISION OF THE CHILDREN ACT OF 1975 REGARDING CONFLICT OF INTEREST BETWEEN PARENT AND CHILD, AND SELECTED REFERENCES.
