SUPPLEMENTARY INFORMATION IS PROVIDED FOR TWO REGULATIONS PROPOSED BY THE FEDERAL RESERVE BOARD, TO IMPLEMENT SECTIONS OF THE ELECTRONIC FUND TRANSFER ACT, WHICH LIMIT CONSUMER LIABILITY AND THE ISSUANCE OF ACCESS CARDS.
Abstract
THE PROPOSED REGULATIONS RELATE TO SECTIONS 911 AND 909 OF THE ACT, WHICH BECAME EFFECTIVE FEBURARY 8, 1979. THE FIRST REGULATION DETAILS THE AMOUNT OF A CONSUMER'S LIABILITY FOR UNAUTHORIZED USE OF THE FUND TRANSFER CARD, SPELLS OUT CIRCUMSTANCES UNDER WHICH THE CONSUMER HAS NO LIABILITY AS WELL AS CIRCUMSTANCES UNDER WHICH THERE MAY BE FULL LIABILITY, AND SETS UP PROCEDURES FOR DETERMINING LIABILITY. THE SECOND REGULATION RESTRICTS THE UNSOLICITED ISSUANCE OF ELECTRONIC FUND TRANSFER CARDS AND ORDERS ISSUERS TO EXPLAIN HOW SUCH CARDS CAN BE DISPOSED OF IF THE CONSUMER DOES NOT WISH THEM. THE RELEASE ALSO CONTAINS THE TEXTS OF MODEL DISCLOSURE CLAUSES WHICH ARE BEING PROPOSED AND TWO TENTATIVE OUTLINES OF REGULATIONS TO IMPLEMENT THE ENTIRE ACT, WHICH WILL GO INTO EFFECT MAY 1980. AN ECONOMIC IMPACT STATEMENT CONTAINS TABLES PRESENTING DATA ON SAVINGS ACCOUNTS, USE OF ELECTRONIC FUNDS TRANSFER FOR PAYROLLS, AND OTHER BACKGROUND INFORMATION. THE TEXTS OF THE SUGGESTED REGULATIONS ALSO CONTAIN GLOSSARIES OF ELECTRONIC FUND TRANSFER TERMS. (GLR)
