A STATE-BY-STATE COMPARISON IS MADE OF THE STRUCTURES AND LEGAL COMPONENTS OF ORGANIZATIONS SET UP TO MONITOR JUDICIAL CONDUCT. IT COVERS SOURCES OF AUTHORITY, STAFF ARRANGEMENTS, AND ACTIONS THE GROUP MAY TAKE.
Abstract
OF THE 62 JUDICIAL CONDUCT ORGANIZATIONS IN OPERATION TODAY, 51 HAVE BEEN IN EXISTENCE SINCE 1960 AND 11 HAVE BEEN CREATED SINCE 1975; 21 COMMISSIONS WERE CREATED BY CONSTITUTIONAL AMENDMENT, 18 COMMISSIONS AND THE OHIO AND PUERTO RICO PROCEDURES WERE ESTABLISHED BY LEGISLATION, AND 8 WERE SET UP BY COURT RULE. ONLY 6 HAVE FULL-TIME ADMINISTRATORS. THIS STUDY SURVEYS THE ACCEPTED GROUNDS FOR DISCIPLINARY ACTION, REMOVAL AND RETIREMENT, JUDICIAL DISCIPLINARY SANCTIONS IMPOSED, NUMBER OF COMPLAINTS RECEIVED, SOURCE OF COMPLAINTS, THE NUMBER OF COMMISSION-INITIATED INVESTIGATIONS, DISPOSITIONS OF COMPLAINTS, NUMBER AND COMPOSITION OF ADMINISTRATIVE STAFF, AND NUMBER AND COMPOSITION OF INVESTIGATION AND PROSECUTION STAFF. EACH COMPARISON CONSISTS OF A CHART GIVING STATE-BY-STATE DATA. A GENERAL DISCUSSION OF THE FINDINGS IS INCLUDED IN THE INTRODUCTORY OVERVIEW. THE FINAL SECTION IS A DIRECTORY OF COMMISSIONS. EACH LISTING CONTAINS THE ADDRESS AND PHONE NUMBER OF THE COMMISSION OFFICE, THE NAME OF THE ADMINISTRATOR, AND A LISTING OF COMMISSION MEMBERS. INFORMATION ON THE PROCESS OF SELECTION FOR MEMBERSHIP AND LENGTH OF TERMS IS ALSO INCLUDED. (GLR)
