THE PLAN FOR ASSURING COMPLIANCE WITH PENNSYLVANIA'S JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT OF 1974 IS DESCRIBED.
Abstract
THE ACT PROVIDES A FOCAL POINT FOR THE COORDINATION OF PROGRAMS TO ENCOURAGE INCREASED DIVERSION OF JUVENILES FROM THE TRADITIONAL JUVENILE JUSTICE SYSTEM. THE STATE PLAN FOR COMPLIANCE WITH THE ACT EMPHASIZES THE ACHIEVEMENT OF TWO MAJOR OBJECTIVES: (1) THE REMOVAL OF ALL STATUS OFFENDERS FROM JUVENILE INSTITUTIONS AND (2) THE SEPARATION OF DETAINED JUVENILES FROM ADULTS IN COUNTY JAILS. FUNDING GUIDELINES HAVE BEEN DEVELOPED AND ADOPTED BY THE JUVENILE JUSTICE AND DELINQUENCY PREVENTION ADVISORY COMMITTEE AND THE GOVERNOR'S JUSTICE COMMISSION PURSUANT TO A POLICY STATEMENT MADE BY THE GOVERNOR. THE GUIDELINES PROVIDE A STRATEGY FOR THE DEVELOPMENT OF COMMUNITY-BASED ALTERNATIVES TO TREAT AND DIVERT STATUS OFFENDERS. ALTHOUGH THE FOCUS IS ON COMMUNITY-BASED ALTERNATIVES, PROVISION HAS BEEN MADE FOR THE USE OF CRIME CONTROL ACT FUNDS TO DEVELOP SMALL SECURE PROGRAMS ON A REGIONAL BASIS AS ALTERNATIVES TO DETENTION IN COUNTY JAILS. THE FUNDING GUIDELINES ARE OUTLINED AS FOLLOWS: (1) PURPOSE (PROGRAM GOALS AND PROGRAM TARGET); (2) WORKING ASSUMPTIONS; (3) PROGRAM STRATEGY (PROJECT DESIGN, APPLICANT ELIGIBILITY, RANGE AND DURATION OF GRANTS, AND DATA REQUIREMENTS FOR EVALUATION); (4) APPLICATION REQUIREMENTS (STATEMENT OF NEED AND PROBLEM DEFINITION, IMPACT OF PROJECT OBJECTIVES ON YOUTH, METHODOLOGY OR WORK PLAN, PROGRAM ACCOUNTABILITY, AND BUDGET NARRATIVE); (5) SELECTION CRITERIA (ESTABLISHED PRIORITIES AND MINIMUM PROGRAM STANDARDS); AND (6) SUBMISSION REQUIREMENTS (SUBMISSION, REVIEW, AND AWARD PROCESSES AND RENEWAL). APPENDIXES CONTAIN STANDARDS FOR THE DETERMINATION OF STATUS OFFENDERS AND INFORMATION ON THE USE OF CRIME CONTROL ACT FUNDS FOR THE CONSTRUCTION OF SECURE DETENTION. (DEP)
