IN A STUDY OF STATE COMPLIANCE WITH THE JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT OF 1974, 48 STATES WERE SURVEYED.
Abstract
THE MAJOR PURPOSE OF THE QUESTIONNAIRE WAS TO DETERMINE THE EXTENT TO WHICH STATES ARE IN COMPLIANCE WITH THE REQUIREMENTS OF THE ACT AND TO REVEAL WHAT ACTIONS ARE BEING TAKEN TOWARDS FUTURE COMPLIANCE. THE QUESTIONNAIRE FOCUSES ON TWO SECTIONS OF THE ACT. THE FIRST REQUIRED THAT STATUS OFFENDERS BE PLACED IN SHELTER FACILITIES RATHER THAN CORRECTIONAL FACILITIES. THE SECOND REQUIRED THAT JUVENILES BE KEPT OUT OF INSTITUTIONS IN WHICH CONTACT WITH ADULTS WOULD BE REGULAR. IT WAS FOUND THAT 11 STATES WERE NOT PARTICIPATING IN THE JUVENILE JUSTICE AND DELINQUENCY ACT OF 1974 AT THE TIME OF DATA COLLECTION. IT WAS ALSO FOUND THAT NINE STATES WERE IN COMPLIANCE WITH THE ACT REGARDING BOTH ALLEGED AND ADJUDICATED STATUS OFFENSE VIOLATORS. THE SURVEY ALSO SHOWED THAT 37 STATES WERE IN COMPLIANCE REGARDING ALLEGED AND ADJUDICATED DELINQUENCY VIOLATORS. LEGISLATION REGARDING STATUS OFFENSE VIOLATORS HAD BEEN PROPOSED BY 16 STATES; STATES WERE EITHER DRAFTING LEGISLATION OR ANTICIPATING THE DRAFTING OF LEGISLATION REGARDING STATUS OFFENDERS. IT WAS ALSO FOUND THAT SEVEN STATES HAD PROPOSED LEGISLATION REGARDING DELINQUENCY VIOLATORS, AND AN ADDITIONAL TWO WERE DRAFTING OR ANTICIPATING THE DRAFTING OF LEGISLATION. METHODOLOGICAL LIMITATIONS OF THE STUDY ARE PRESENTED. A STATE-BY-STATE ANALYSIS OF COMPLIANCE IS SUGGESTED AS AN ALTERNATIVE METHOD OF INVESTIGATION. DATA COLLECTION INSTRUMENTS AND TABLES ARE INCLUDED. (MLC)
