ARREST WARRANT FORMS ARE PROPOSED FOR THE OFFENSES OF FALSE PRETENSES, WORTHLESS CHECKS, FORGERY, AND CREDIT CARD CRIMES FOR NORTH CAROLINA.
Abstract
THE PROPOSED FORMS ARE INTENDED FOR USE WITH THE STANDARD ADMINISTRATIVE OFFICE OF THE COURTS WARRANT FOR ARREST (AOC-L FORM 250), CRIMINAL SUMMONS (FORM 252), OR MAGISTRATE'S ORDER (FORM 253). REVISIONS IN THE PRESENT FORMS ARE INDICATED. THE FORM OF CHARGE, A SAMPLE AFFIDAVIT, AND THE PUNISHMENT ARE INDICATED FOR EACH OF THE FOLLOWING OFFENSES: (1) OBTAINING PROPERTY BY FALSE PRETENSES, (2) OBTAINING PROPERTY FOR WORTHLESS CHECK, (3) WRITING WORTHLESS CHECKS (SIMPLE WORTHLESS CHECK, PRINCIPAL OFFENDER, SIMPLE WORTHLESS CHECK, AIDER AND ABETTOR, CHECK WRITTEN ON NONEXISTENT ACCOUNT, PRINCIPAL OFFENDER, CHECK WRITTEN ON NONEXISTENT ACCOUNT, AIDER AND ABETTOR, CHECK WRITTEN ON CLOSED ACCOUNT, PRINCIPAL OFFENDER, CHECK WRITTEN ON CLOSED ACCOUNT, AIDER AND ABETTOR, (4) FORGING NOTES, CHECKS, AND SECURITIES, (5) FORGING OTHER PAPERS, (6) UTTERING FORGED PAPER, (7) FORGING ENDORSEMENT, (8) UTTERING PAPER WITH FORGED (7) FORGING ENDORSEMENT, (8) UTTERING PAPER WITH FORGED ENDORSEMENT, (9) CREDIT CARD THEFT, RECEIVING STOLEN OR LOST CREDIT CARD (RECEIVING STOLEN CREDIT CARD, RECEIVING LOST OR MISDELIVERED CREDIT CARD), (10) CREDIT CARD THEFT--TAKING CARD, (11) CREDIT CARD THEFT, SELLING OR BUYING CREDIT CARD, (12) CREDIT CARD FORGERY, (13) CREDIT CARD FRAUD (OBTAINING PROPERTY FRAUDULENTLY, FURNISHING PROPERTY FRAUDULENTLY), (14) POSSESSION OF CREDIT CARD FORGERY DEVICES (POSSESSION OF MORE THAN ONE INCOMPLETE CARD, POSSESSION OF MACHINERY TO MAKE CARD), AND (15) RECEIVING GOODS OR SERVICES OBTAINED BY CREDIT CARD FRAUD (GOODS WORTH $500 OR LESS, GOODS WORTH MORE THAN $500).
