Abstract
THIS MANUAL OF TRAINING MATERIALS WAS MADE POSSIBLE BY FUNDS GRANTED TO THE MISSOURI SUPREME COURT BY THE LEAA AND THE MISSOURI COUNCIL ON CRIMINAL JUSTICE. FOUR PARTS COMPRISE THE MISSOURI CRIMINAL CODE AND RELATED TRAINING MATERIALS: (1) PRELIMINARY MATTERS (CLASSES OF CRIMES, INFRACTIONS, TIME LIMITATIONS, LIMITATIONS ON CONVICTIONS FOR MULTIPLE OFFENSES, AFFIRMATIVE DEFENSE, AND PENALTY RANGES); (2) SENTENCING; (3) GENERAL PRINCIPLES AND DEFENSES APPLICABLE TO ALL CRIMES; AND (4) DEFINITIONS OF PARTICULAR OFFENSES. CODE SECTIONS ON GENERAL PRINCIPLES OF LIABILITY ENCOMPASS BASIC REQUIREMENTS OF CONDUCT, CULPABLE MENTAL STATES, AND ACCESSORY LIABILITY AND ALSO SOME GENERAL DEFENSES SUCH AS ENTRAPMENT, DURESS, AND THE EFFECT OF INTOXICATION ON CRIMINAL LIABILITY. OTHER CODE SECTIONS DEAL WITH JUSTIFICATION (SITUATIONS WHERE THE USE OF FORCE IS JUSTIFIED, INCLUDING SELF-DEFENSE, THE DEFENSE OF OTHER PERSONS, THE DEFENSE OF PREMISES AND PROPERTY, AND EFFECTING ARREST) AND ATTEMPT AND CONSPIRACY (APPLICABLE TO ALL TYPES OF OFFENSES). ELEMENTS OF, COMMENTS ON, AND EXAMPLES OF THE FOLLOWING SPECIFIC CRIMES ARE PROVIDED: HOMICIDE, ASSAULT, AND KIDNAPPING; SEXUAL OFFENSES; DRUG OFFENSES; ROBBERY, ARSON, BURGLARY, AND RELATED OFFENSES; STEALING AND RELATED OFFENSES; ARMED CRIMINAL ACTION AND WEAPON OFFENSES; OFFENSES AGAINST THE PUBLIC ORDER; OFFENSES AGAINST THE ADMINISTRATION OF JUSTICE AND OFFENSES AFFECTING GOVERNMENT; PROSTITUTION; OFFENSES AGAINST THE FAMILY; GAMBLING; PORNOGRAPHY AND RELATED OFFENSES; AND MISCELLANEOUS OFFENSES AFFECTING PUBLIC SAFETY.
