THIS HANDBOOK CONTAINS THE ORGANIZATIONAL CHART OF THE ITALIAN POLICE SYSTEM; A DETAILED DESCRIPTION OF ITS PROCEDURES, FUNCTIONS, POWERS AND RESTRAINTS; AND THE TEXTS OF CRIMINAL AND PENAL LAWS.
Abstract
A DESCRIPTION OUTLINES THE ORGANIZATIONAL FORM OF THE ITALIAN GOVERNMENT AND ITS CONSTITUTION, AND PROVIDES A SUBJECT INDEX TO THE FULL TEXT OF VARIOUS LAWS, EXCERPTS FROM THE ITALIAN CONSTITUTION ON THE MOST IMPORTANT CONSTITUTIONAL GUARANTEES, AND EXCERPTS FROM DECLARATIONS ISSUED BY INTERNATIONAL CONVENTIONS ON HUMAN RIGHTS AND RIGHTS UNDER THE LAW. AN ORGANIZATIONAL CHART OF THE ITALIAN JUDICIAL POLICE LISTS FUNCTIONS AND DUTIES AT ALL HIERARCHICAL LEVELS; FURTHER LISTS ENUMERATE ITALIAN COURTS OF LAW WITH THEIR JURISDICTIONS AND GEOGRAPHIC LOCATIONS; CRIMES FOR WHICH THE POLICE ARE OBLIGATED BY LAW TO ARREST THE PERPETRATORS, WHEN CAUGHT IN THE ACT OR IMMEDIATELY AFTER, AT THE SCENE OF THE CRIME; SUSPICIOUS CIRCUMSTANCES UNDER WHICH THE POLICE MAY ASK CITIZENS TO ACCOMPANY THEM TO THE POLICE STATION AND DETAIN THEM TEMPORARILY FOR IDENTIFICATION AND INTERROGATION; AND EMERGENCY SITUATIONS IN WHICH SUSPECTS MAY BE INTERROGATED WITHOUT THE PRESENCE OF THEIR ATTORNEYS, AS OTHERWISE REQUIRED BY LAW. REGULATIONS ARE DETAILED ON POLICE INTERROGATION OF SUSPECTS, WITH SAMPLES OF TRANSCRIPTS, REPORTS, AND OTHER DOCUMENTS; ON HOW TO CONDUCT HOUSE SEARCHES WITH AND WITHOUT WARRANTS; ON THE CONFISCATION OF DRUGS CARRIED BY SUSPECTS FOR THEIR PERSONAL USE; ON PERSONAL (BODILY) SEARCHES; ON ADMISSIBLE EVIDENCE (E.G., ELECTRONIC EAVESDROPPING); ON FINES AND THEIR DECRIMINALIZATION (I.E., WHEN FAILURE TO PAY A FINE IS NOT A CRIMINAL OFFENSE); AND ON TRAFFIC RELATED OFFENSES, INCLUDING WHEN POLICE SHOULD PURSUE AUTOMOBILES WHOSE DRIVERS ARE IN VIOLATION OF SOME LAW OR REGULATION. EXCERPTS FROM THE ITALIAN CODES OF CRIMINAL AND PENAL LAW DEAL WITH ABORTION, GUN CONTROL, EXPLOSIVES, AND THE USE OF WEAPONS BY POLICE. A SUMMARY REFERS TO THE NATIONAL SECURITY AND SECRET SERVICE SYSTEMS IN FRANCE, WEST GERMANY, AND GREAT BRITAIN AND IS FOLLOWED BY A DETAILED DESCRIPTION, COMPLETE WITH ORGANIZATIONAL CHART, OF THE ITALIAN NATIONAL SECURITY AND SECRET SERVICE APPARATUS AND ANTI-TERRORIST UNITS. FINALLY, EXCERPTS FROM, AND SOME FULL TEXTS OF, LAWS ON DRUG ABUSE, DRUG ADDICT REHABILITATION SERVICES, AND DRUG ABUSE PREVENTION ARE PROVIDED, AND MATTERS PERTAINING TO CIVIL LAW ARE COVERED. --IN ITALIAN.
