As tribes implement enhanced sentencing authority within tribal courts it is important to consider what types of offenses can be subject to enhanced sentencing. The Tribal Law and Order Act (TLOA) provisions included broad provisions pertaining to the types of crimes that can be subject to enhanced sentencing. This webinar will:
-Provide participants with an introduction to enhanced sentencing provisions authorized in Section 234 of the Tribal Law and Order Act (Pub L. No. 111-211, 124 Stat 2261 (2010);
-Discuss the TLOA’s authorization requirements;
- Discuss how to prove prior conviction; and
- Discuss appointment of legal counsel and qualifications of legal counsel.
