NCVLI has been training nationally on victims' rights for more than 10 years and the recurring mantra from the field is "We can't litigate that in our state." Importantly, the law provides standing for victims to litigate at least some of their rights in every state at the trial level and there is some appellate review available for most rights violations. Unfortunately, because of the legacy of victims being perceived as witnesses or evidence in a case rather than interested participants too few lawyers and judges undertake a true standing analysis. This training would be an in-depth discussion of legal standing and the "how" of litigating when others say you can’t do it.
