Annotation: Directed to California police officers and agencies, this document presents case law and interpretive guidance designed for police agencies responsible for enforcing the Americans with Disabilities Act of 1990.
Abstract: The information provided is general in scope and detail and is not intended either as legal guidance or as a replacement for consultation with legal counsel. Individual sections explain who is covered, what a disability is, issues related to drug use, the meaning of essential job functions, and methods of determining if an accommodation is needed and choosing a reasonable accommodation. Further sections focus on the meaning of undue hardship, options for reasonable accommodation, selection procedures and qualification standards, preemployment inquiries regarding such topics as attendance and workers' compensation, and prohibitions on preoffer inquiries. Other sections discuss medical inquiries prior to the basic police academy, offers of employment, medical examinations, direct threats, confidentiality, appeals and grievance procedures, insurance, and enforcement.
