Annotation: The use of reflective empathy in a forensic examination is explored.
Abstract: This article discusses what happens after an examinee is told that the results of a court-ordered examination would not be privileged. The question then becomes: Should the examiner be permitted to use any technique short of physical violence to gain information. For instance should the court-ordered examiner be permitted to use therapeutic relationship building as a tool to gather information during an assessment? The importance of drawing a bright line between forensic assessment and therapeutic services is covered as is the use of empathy in court-ordered examinations in criminal cases. Ethical problems are addressed. References
