Annotation: This report presents data on sexual assault, sexual assault of a spouse, and the false reporting of sexual assault in Arizona for the years 2004 and 2005, as required under Arizona Revised Statute 41-2406.B, which became law in July 2005.
Abstract: Based on disposition reporting forms submitted to the Arizona Department of Public Safety, in 2004, 470 charges of sexual assault were included in the 282 reports. Sixty-nine convictions were obtained, 55 for the original charge of sexual assault. The sentences were 41 to probation, 25 to prison, 8 to jail, 5 fines, and 37 other undefined sentences. In 2005, 531 charges of sexual assault were included in 296 arrest reports. At the time data were collected for this report, 28 convictions had been obtained, 21 for the original charge of sexual assault. The sentences included 12 to prison, 10 to probation, 3 to jail, 1 fine, and 7 undefined sentences. Many charged with sexual assault may not have reached final disposition by January 2006 when this report was prepared. In 2004, 19 charges of sexual assault were included in 10 arrest reports. Three convictions were obtained, one of which was for the original charge of sexual assault of a spouse. The sentence was probation. In 2005, 22 charges of sexual assault of a spouse appeared in the 18 arrest reports. At the time this report was compiled, no record of any conviction on the original charge was available. In 2004, there were 6,235 charges of false reporting of a sexual assault. In 2004, there was no separate distinction for the false reporting of sexual assault by a spouse. This did not become a separate offense under Arizona law until July 25, 2005. There were no charges of false reporting of sexual assault that involved a spouse in 2005. There were 6,201 charges of false reporting of an offense to law enforcement in 2005. 4 tables
