Annotation: THE MATERIAL IN THIS TEXTBOOK COVERS THE ENTIRE CORRECTIONAL PROCESS FROM PRETRIAL DIVERSION TO THE RESTORATION OF OFFENDERS RIGHTS UPON THEIR RELEASE FROM INSTITUTIONS.
Abstract: CERTAIN MATTERS HAVE RECEIVED SPECIAL ATTENTION, SUCH AS PLEA BARGAINING; ISSUES SURROUNDING CRUEL AND UNUSUAL PUNISHMENT, THE RIGHT TO TREATMENT, AND THE RIGHT NOT TO BE TREATED; AND THE PAROLE PROCESS. IN ADDITION, THE REQUISITES OF THE FEDERAL CIVIL RIGHTS ACT AND THE TYPES OF REMEDIES WHICH MAY BE AVAILABLE IF RIGHTS ARE VIOLATED ARE EXAMINED IN DETAIL. ALTHOUGH PRIORITY IS GIVEN TO ANALYZING THE APPLICABILITY OF VARIOUS CONSTITUTIONAL GUARANTEES TO THE CORRECTIONAL PROCESS, ISSUES RELAXING MORE BROADLY TO LAW REFORM AND PUBLIC POLICY ARE ADDRESSED AS WELL. INDIVIDUAL CHAPTERS COVER THE SENTENCING PROCESS, LOSS OF RIGHTS, INCARCERATION, PRISONERS' RIGHTS AND RESPONSIBILITIES, PRISONERS' REMEDIES, CORRECTIONS IN THE COMMUNITY, AND THE RESTORATION OF RIGHTS OF OFFENDERS. THIS TEXT INCLUDES SIGNIFICANT CASES REPORTED THROUGH OCTOBER 1975, AND IS INTENDED FOR USE BOTH WITHIN AN ACADEMIC SETTING AND FOR THOSE WHO HAVE DIRECT CONTACT WITH THE PROBLEMS AND ISSUES THE BOOK EXAMINES - INMATES, CORRECTIONAL OFFICIALS, JUDGES, PLAINTIFF AND DEFENSE COUNSEL, AND LEGISLATORS, AMONG OTHERS.
