Annotation: THIS ANALYSIS WAS PROMPTED BY THE BELIEF THAT A LAW WILL BE MUCH BETTER APPLIED IF IT CORRESPONDS TO THE CONTEMPORARY ATTITUDES OF A SOCIETY.
Abstract: IT IS BASED ON BRIEFS SUBMITTED TO VARIOUS CANADIAN FEDERAL AND PROVINCIAL COMMISSIONS OF INQUIRY BETWEEN 1962 AND 1972. THE BRIEFS PROVIDED TO THESE COMMISSIONS CAME MOSTLY FROM INDIVIDUALS OR ORGANIZATIONS IN QUEBEC AND ONTARIO MORE OR LESS CONNECTED WITH THE LEGAL OR CORRECTIONAL MILIEU. PUBLIC OPINION ON FORMAL OFFENSES, ARRESTS AND INQUIRY, TREATMENT OF INDIVIDUALS CONSIDERED DEVIANTS, AND NATIONAL SECURITY WAS SURVEYED. GENERALLY, RESPONDENTS CALLED FOR AN INCREASED RESPECT FOR THE INDIVIDUAL FREEDOMS AND RIGHTS, WHILE AT THE SAME TIME HOPING FOR A GENERAL REFORM OF THE CORRECTIONAL MILIEU. SPECIFICALLY, THEY RECOMMENDED A REVISION OF LEGISLATION PERTAINING TO SEVERAL OFFENSES HAVING A MORAL CONNOTATION (SUCH AS ABORTION), RESPECT FOR INDIVIDUAL PRIVACY AND BASIC FREEDOMS EVEN TO THE DETRIMENT OF THE EFFICIENCY OF POLICE INQUIRY, AND RECOURSE TO THERAPEUTIC MEASURES FOR CERTAIN TYPES OF OFFENDERS (ALCOHOLICS, DRUG USERS, DANGEROUS SEXUAL OFFENDERS.) --IN ENGLISH AND FRENCH....ELW
