Abstract: RECOMMENDATIONS ARE MADE FOR REFORM OF THE PENAL CODE IN LIGHT OF THE INCREASED ACCEPTANCE OF INDIVIDUAL PREVENTION OVER GENERAL PREVENTIVE MEASURES. THE REFORM IS BASED ON THE PREFERENCE FOR THE DEPRIVATION OF LIBERTY TO SEVERITY OF ENFORCEMENT.
