Annotation: THIS ARTICLE ARGUES THAT IT IS UNCONSCIONABLE TO FORCE THE INNOCENT TO BEAR THE OFTEN CRUSHING COSTS OF MISTAKES IN THE CRIMINAL JUSTICE SYSTEM, AND THAT A RIGHT TO COMPENSATION FOR ERRONEOUS PROSECUTION BE CREATED.
Abstract: THE ARTICLE EXPLORES LIABILITY THEORIES UPON WHICH SUCH A RIGHT MIGHT BE BASED, AS WELL AS THE DIFFICULTIES IN DETERMINING THE MEANING OF INNOCENCE. FINALLY, THE ARTICLE SUGGESTS SEVERAL TECHNIQUES BY WHICH A RIGHT TO COMPENSATION MIGHT BE IMPLEMENTED. (AUTHOR ABSTRACT)... MSP
