Annotation: THE 1969 HIJACKING LAW ENACTED IN BRAZIL DEFINES CRIMES OF SMUGGLING AND THE TRANSPORT OF TERRORISTS AND SUBVERSIVES IN AIRCRAFT IN RELATION TO NATIONAL SECURITY.
Abstract: THE FIRST ARTICLE OF THE BRAZILIAN LAW DEFINES CRIMES RELATED TO NATIONAL SECURITY AND ASSOCIATED PENALTIES THAT INVOLVE IMPRISONMENT FROM 8 TO 20 YEARS. SUBSEQUENT ARTICLES COVER THE COMMISSION OF CRIMES ON PRIVATE AIRCRAFT AND THE SEIZURE OF SUCH AIRCRAFT; THE INITIATION OF A MILITARY POLICE INVESTIGATION WITHIN 36 HOURS AFTER AN AIRCRAFT HAS BEEN SEIZED; AND THE HANDLING OF SEIZED AIRCRAFT, VEHICLES AND COMMUNICATION EQUIPMENT BY MILITARY COURTS DURING A MILITARY POLICE INVESTIGATION. THE LAW COVERS RESPONSIBILITIES OF THE BRAZILIAN MINISTRY OF AERONAUTICS; TRIAL PROCEDURES TO FOLLOW AFTER COMPLETION OF A MILITARY POLICE INVESTIGATION; THE IMPOSITION OF PENALTIES UNDER THE BRAZILIAN AIR CODE; AND COMMANDANTS OF AERIAL ZONES IN JURISDICTIONS WHERE AIRCRAFT, VEHICLES, AND COMMUNICATION EQUIPMENT ARE SEIZED AS THE RESULT OF A MILITARY POLICE INVESTIGATION AND POLICE INQUIRIES INITIATED PURSUANT TO OTHER LAWS IN FORCE. BY THE BRAZILIAN DECREE/LAW IT IS AN OFFENSE AGAINST NATIONAL SECURITY TO TRANSPORT IN AN AIRCRAFT ANY TERRORISTS, SUBVERSIVES, OR PERSONS WANTED BY THE POLICE, OR TO COLLABORATE THROUGH ILLEGAL FLIGHTS IN THE TRANSPORTATION OF SUCH PERSONS.
