Annotation: TESTIMONY IS PRESENTED FROM HEARINGS BEFORE THE SENATE COMMITTEE ON GOVERNMENTAL AFFAIRS ON SENATE BILL 555, DEALING WITH GENERAL AND SPECIFIC MISCONDUCT BY FEDERAL OFFICIALS.
Abstract: TESTIMONY IS PRESENTED ON TITLES I AND II OF THE BILL, WHICH PROVIDES FOR THE COURT'S APPOINTMENT OF A TEMPORARY SPECIAL PROSECUTOR WHEN SERIOUS ALLEGATIONS ARE PUT FORTH THAT A HIGH-LEVEL MEMBER OF THE EXECUTIVE BRANCH HAS VIOLATED A FEDERAL CRIMINAL STATUTE (TITLE I) AND ESTABLISHES A CONGRESSIONAL LEGAL COUNSEL TO REPRESENT CONGRESS IN CIVIL LITIGATION INVOLVING ITS POWERS (TITLE II). TITLE I ALSO ESTABLISHES AN OFFICE OF GOVERNMENT CRIME WITHIN THE DEPARTMENT OF JUSTICE FOR THE PURPOSE OF HANDLING ALLEGED CRIMINAL VIOLATIONS BY FEDERAL OFFICERS OR EMPLOYEES NOT REFERRED TO A SPECIAL PROSECUTOR. TESTIMONY IS GIVEN BY REPRESENTATIVES FROM THE LEGISLATIVE AND EXECUTIVE BRANCHES, THE AMERICAN BAR ASSOCIATION, AND COMMON CAUSE. THE LAST TWO OF THE FIVE HEARINGS ARE CONCERNED WITH WHETHER BLIND TRUSTS ARE EFFECTIVE IN INSULATING GOVERNMENT OFFICIALS FROM CONFLICTS OF INTEREST. TESTIMONY IS ALSO HEARD ON SENATE BILL 695 WHICH DEALS WITH CONFLICTS OF INTEREST CONCERNING THE EMPLOYMENT OF GOVERNMENT OFFICIALS IN COMPANIES HAVING BUSINESS WITH THE GOVERNMENT. TESTIMONY ON CONFLICT OF INTEREST IS PRESENTED BY REPRESENTATIVES FROM THE LEGISLATIVE AND EXECUTIVE BRANCHES, LEGAL ASSOCIATIONS, AND CITIZEN GROUPS. COPIES OF THE BILLS CONSIDERED ARE INCLUDED, ALONG WITH ADDITIONAL MATERIALS SUPPLIED FOR THE RECORD. (RCB)
