Annotation: THE PROVISIONS OF THE JUSTICE SYSTEM IMPROVEMENT ACT OF 1979 AIM AT RESTRUCTURING LEAA, ASSISTING STATE AND LOCAL GOVERNMENTS IN IMPROVING THE QUALITY OF THEIR JUSTICE SYSTEMS, AND DEALING WITH OTHER RELATED ITEMS.
Abstract: THE ACT, PUBLIC LAW 96-157, IS COMPLETELY REPRESENTED HERE, FROM DECLARATION AND PURPOSE THROUGH DEFINITIONS AND PROVISIONS. FOR LEAA AND THE NATIONAL INSTITUTE OF JUSTICE (NIJ), THE ACT PRESENTS GENERAL OBJECTIVES, THE DUTIES AND FUNCTIONS OF ADMINISTRATORS, AND SUCH SPECIAL COMPONENTS AS THE OFFICE OF COMMUNITY ANTI-CRIME PROGRAMS UNDER LEAA AND THE NIJ ADVISORY BOARD. AUTHORITY FOR 100 PER CENTUM GRANTS IS DELINEATED FOR BOTH NIJ AND THE BUREAU OF JUSTICE STATISTICS. DUTIES AND FUNCTIONS OF THE BUREAU ARE DETAILED, ALONG WITH GUIDELINES FOR AN ADVISORY BOARD AND THE USE OF THE BUREAU'S DATA. THE ACT'S REGULATIONS FOR FORMULA GRANTS, NATIONAL PRIORITY GRANTS, AND DISCRETIONARY GRANTS COVER GRANT PURPOSES, ELIGIBILITY, APPLICATIONS, CRITERIA FOR AWARDS, APPROPRIATION OR ALLOCATION PERCENTAGES, AND OTHER RELATED PROCEDURES. PROVISIONS CONCERNING TRAINING AND MANPOWER DEVELOPMENT DEAL WITH ENCOURAGING TRAINING, MANPOWER DEVELOPMENT, AND NEW PERSONNEL PRACTICES WITH A VIEW TO IMPROVING THE CRIMINAL JUSTICE SYSTEM; PARTICULAR SECTIONS FOCUS ON PROSECUTING ATTORNEYS, STATE AND LOCAL CRIMINAL JUSTICE PERSONNEL, CRIMINAL JUSTICE EDUCATION, AND FBI TRAINING. EXTENSIVE ADMINISTRATIVE PROVISIONS STIPULATE GUIDELINES FOR SUCH ASPECTS OF THE ACT AS THE ESTABLISHMENT OF THE OFFICE OF JUSTICE ASSISTANCE, RESEARCH, AND STATISTICS; CONSULTATION CONSIDERATIONS; SUBPOENA POWER; CONFIDENTIALITY OF INFORMATION; AUTHORITY TO ACCEPT VOLUNTARY SERVICES; A DISTRICT OF COLUMBIA MATCHING SOURCE; AND PROHIBITION ON THE USE OF CIA SERVICES. FURTHER PROVISIONS ACCOUNT FOR GENERAL DEFINITIONS OF THE ACT, FUNDING, CRIMINAL PENALTIES TIED TO ANY OF THE DEPARTMENTS MENTIONED IN THE ACT, AND DEATH BENEFITS FOR PUBLIC SAFETY OFFICERS. FINALLY, INFORMATION IS GIVEN ON TRANSITION PROCEDURES, THE ACT'S EFFECTIVE DATE, AND THE REPEALER. (MHP)
