Annotation: THE CLASSIFICATION OF JUVENILES, DISPOSITIONAL ALTERNATIVES, AND STATUTORY PROVISIONS OF INCARCERATION OF JUVENILES IN JAILS ARE DESCRIBED FOR THE 50 STATES, DISTRICT OF COLUMBIA, AND PUERTO RICO.
Abstract: THE MATERIAL WAS COMPILED IN MID-1979 BY THE STAFF OF THE NATIONAL JUVENILE CENTER UNDER A LEAA GRANT. EACH SECTION CONTAINS A NARRATIVE SUMMARY OF STATE JUVENILE CODES FOLLOWED BY CHARTS WHICH PERMIT COMPARISONS AMONG STATES. IN ADDITION, A LIST OF JUVENILE CODE CITATIONS INDICATES THE RELEVANT STATUTES AND THEIR DATES FROM WHICH THE CHART INFORMATION WAS DRAWN. IN THE ANALYSIS OF JUVENILE CLASSIFICATIONS, THE MAIN CATEGORIES USED ARE DELINQUENT, STATUS OFFENDER, AND DEPENDENT OR NEGLECTED CHILD. THE DISPOSITIONAL ALTERNATIVES CHART SHOWS POSTADJUDICATION ALTERNATIVES FOR THESE GROUPS IN EACH STATE, INCLUDING DISMISSALS, PROTECTIVE SUPERVISION, PROBATION, RESTITUTION, AND PLACEMENTS IN VARIOUS TYPES OF CORRECTIONAL FACILITIES. MANY JUVENILES ARE DETAINED IN JAILS DAILY, DESPITE EXTENSIVE RESTRICTIONS ON THESE PRACTICES. ALTHOUGH ALMOST ALL STATES REQUIRE THAT JUVENILES PLACED IN JAILS BE SEPARATED FROM ADULTS, THE TYPE AND DEGREE OF SEPARATION VARIES CONSIDERABLY. THE CHART ON PRETRIAL INCARCERATION OF JUVENILES IN ADULT FACILITIES GROUPS STATUTORY PROVISIONS INTO FOUR TYPES: STATES THAT FOLLOW THE SEPARATION LANGUAGE OF THE JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT OF 1974; STATES THAT REQUIRE THE PHYSICAL SEPARATION OF JUVENILES AND ADULTS; STATES THAT REQUIRE 'SIGHT AND/OR SOUND' SEPARATION; AND STATES THAT REQUIRE THE CHILD TO BE KEPT IN A SEPARATE JAIL CELL. THIS CHART ALSO USES THE DELINQUENT, STATUS OFFENDER, AND NEGLECTED CHILD CATEGORIES. THE TEXTS OF EACH STATE'S STATUTES ON JUVENILE PRETRIAL INCARCERATION ARE PROVIDED. THE APPENDIXES CONTAIN WASHINGTON STATUTES ON PROCEDURES FOR FAMILIES IN CONFLICT AND DISPOSITION OF DELINQUENTS, AS WELL AS THE WEST VIRGINIA JUVENILE OFFENDER REHABILITATION ACT. JUVENILE CODE CITATIONS FROM ALL STATES, THE DISTRICT OF COLUMBIA, PUERTO RICO, AND THE U.S. CODE ARE APPENDED. (MJM)
