Annotation: THIS ORDINANCE ESTABLISHES A PROCUREMENT CODE FOR EAU CLAIRE, WIS., AND INCLUDES PROVISIONS RELEVANT TO PROCUREMENT BY THE CITY.
Abstract: DEFINITIONS OF TERMS AND GENERAL CONSTRUCTION AND APPLICATION RULES ARE PRESENTED. INCLUDED ARE PROVISIONS FOR THE AUTHORITY OF PURCHASING AGENT, CREATION OF PROCUREMENT POLICY, DELEGATION OF AUTHORITY, CENTRALIZATION OF PROCUREMENT AUTHORITY, AND METHODS OF SOURCE SELECTION (COMPETITIVE SEALED BIDDING). OTHER SECTIONS DISCUSS SMALL PURCHASES, SOLE SOURCE PROCUREMENTS, EMERGENCY PROCUREMENTS, MODIFICATION OF CONTRACTS, CANCELLATION OF INVITATION FOR BIDS OR REQUESTS FOR PROPOSALS, AND FINALITY OF DETERMINATIONS. DUTIES OF THE PURCHASING AGENT ARE SPECIFIED, ALONG WITH PROVISIONS FOR SUPPLY MANGEMENT, COOPERATIVE PURCHASING, ETHICS IN PUBLIC CONTRACTING, EMPLOYEE DISCLOSURE REQUIREMENTS, GRATUITIES AND KICKBACKS, RESTRICTIONS ON EMPLOYMENT OF PRESENT AND FORMER EMPLOYEES, PROHIBITION AGAINST CONTINGENT FEES, AND USE OF CONFIDENTIAL INFORMATION. OTHER SECTIONS PROVIDE FOR PUBLIC ACCESS TO PROCUREMENT INFORMATION, CIVIL AND ADMINISTRATIVE REMEDIES AGAINST EMPLOYEES AND NONEMPLOYEES, RECOVERY OF VALUE TRANSFERRED OR RECEIVED, AND A WRITTEN WAIVER.
