Abstract: BECAUSE MOST ENGLISH MAGISTRATES ARE LAYPERSONS, FREQUENT COMPLAINTS ARE EXPRESSED CONCERNING THEIR FAILURE TO FOLLOW THE WORDING OF RELEVANT STATUTES AND APPEAL COURT DECISIONS. IN ADDITION TO SERVING AS A HANDBOOK FOR MAGISTRATES, THIS BOOKLET IS INTENDED AS A REFERENCE BOOK FOR COURT CLERKS, WHO SHOULD BE AWARE OF RELEVANT AUTHORITIES WHEN ADVISING MAGISTRATES. THE BOOKLET CAN ALSO BE OF ASSISTANCE TO ATTORNEYS WHO PRACTICE IN MAGISTRATES' COURTS, AS WELL AS POLICE OFFICERS, PROBATION OFFICERS, AND OTHERS IN THE COURT SYSTEM. ISSUES ARE CONSIDERED UNDER THE GENERAL CATEGORIES OF CRIMINAL PROCEEDINGS, DOMESTIC PROCEEDINGS, AND JUVENILE ISSUES. ISSUES TREATED UNDER CRIMINAL PROCEEDINGS INCLUDE BINDING-OVER, COMMITTALS TO THE CROWN COURT FOR SENTENCING AND TRIAL, CONDITIONAL DISCHARGES AND PROBATION ORDERS, IMPRISONMENT, REMAND, AND EVIDENCE. ISSUES CONSIDERED UNDER DOMESTIC PROCEEDINGS ARE EVIDENCE, JUSTICES, NONCOHABITATION CLAUSE, NO CASE TO ANSWER, AND PRACTICE AND PROCEDURE. JUVENILES APPEARING WITH ADULTS AND UNDER SUPERVISION ORDERS ARE ALSO DISCUSSED. AN INDEX OF CASES CITED AND FOOTNOTES ARE INCLUDED. (RCB)
