Annotation: A HANDBOOK DEALING WITH THE FUNCTIONING OF THE COURTS, THE OFFICERS OF THE COURTS, AND THE POWERS AND DUTIES OF COURT PERSONNEL OF CANADA IS PRESENTED; POLICE OFFICER FUNCTIONS ARE NOT INCLUDED.
Abstract: THE PUBLICATION BRIDGES THE GAP BETWEEN SECONDARY SCHOOL TEXTS AND DETAILED LEGAL MATERIALS IN ITS DESCRIPTION OF THE CANADIAN CRIMINAL COURTS. SUBJECTS INCLUDE HISTORICAL BACKGROUND OF THE COURT STRUCTURE, RIGHTS OF INDIVIDUALS, COMPELLING THE ATTENDANCE OF AN ACCUSED PERSON IN COURT, INTERIM RELEASE, TYPES OF COURTS, AND PROCEDURES SURROUNDING SUMMARY CONVICTION CRIMINAL OFFENSES, PRELIMINARY INQUIRY, INDICTABLE OFFENSES, EMPANELLING A JURY, TRIAL BY INDICTMENT, AND APPEALS. REVIEW QUESTIONS ARE PROVIDED AT THE END OF EACH CHAPTER; CITATIONS REFER TO THE CRIMINAL CODE OF CANADA. IN CANADA OVER 90 PERCENT OF THE CRIMINAL ACTIONS ARE ADJUDICATED IN PROVINCIAL JUDGES COURT. A PROVINCIAL COURT JUDGE SITS ALONE AND HAS THE JURISDICTION TO TRY EVERY OFFENSE AGAINST MUNICIPAL BYLAWS, PROVINCIAL STATUTES, AND ALL FEDERAL STATUTES INCLUDING THE CRIMINAL CODE OF CANADA. A GLOSSARY OF TERMS IS APPENDED, AS ARE A LIST OF OFFENSES FALLING WITHIN SECTION 483, 427, 429, AND 457 OF THE CRIMINAL CODE, AND A SCHEDULE OF OFFENSES ALONGSIDE THEIR APPLICABLE PRISON SENTENCE OR FINE.
