Annotation: THE RIGHTS OF THE ACCUSED FROM THE TIME OF ARREST THROUGH TRIAL AND APPEALS PROCEDURES ARE SET FORTH IN SIMPLE, BUT LEGALLY ACCURATE, LANGUAGE TO HELP POOR DEFENDANTS AVOID ABUSES BY POLICE AND THE COURTS.
Abstract: FROM QUESTIONS ABOUT LEGALITY OF ARREST THROUGH PLEA BARGAINING, MAKING BAIL, USING THE PRELIMINARY HEARING, TESTIFYING BEFORE A GRAND JURY, ARRAIGNMENT, AND RULES OF EVIDENCE, THIS MANUAL GIVES COMPREHENSIVE ADVICE TO THE PERSON ACCUSED OF A CRIME. IT EXPLAINS LEGAL PROCEDURES, GIVES ADVICE ON BEHAVIOR WITH THE POLICE AND COURTS, AND RECOMMENDS WAYS TO FIND A GOOD LAWYER. SPECIAL SECTIONS COVER THE INTRICACIES OF TRIAL PROCEDURES AND A SPECIAL CHAPTER COVERS JUVENILE LAW. PRO SE MOTIONS ARE DISCUSSED. A FINAL CHAPTER COVERS THE DEPORTATION OF ALIENS AND IMMIGRATION LAW IN GENERAL. THE MANUAL IS THE WORK OF THE BROOKLYN HOUSE OF DETENTION COLLECTIVE PROJECT OF THE CENTER FOR CONSTITUTIONAL RIGHTS, AND AS SUCH, FOCUSES ON NEW YORK LAW. HOWEVER, THE PRINCIPLES ARE GENERAL AND CAN BE APPLIED IN MOST OTHER JURISDICTIONS. APPENDIXES CONTAIN A GLOSSARY, A LISTING OF COMMON MOTIONS WITH A SHORT DESCRIPTION OF EACH, AND A FELONY PROCEDURE CHART WHICH IS A DIAGRAM OF THE MOVEMENT OF AN ACCUSED PERSON THROUGH THE CRIMINAL JUSTICE SYSTEM.
