Annotation: THE SENTENCING PROCESS AND THE PRINCIPLES OF CRIMINAL JUSTICE DELIVERY, AS SEEN BY THE COURT OF CRIMINAL APPEAL IN QUEENSLAND, AUSTRALIA, ARE THE SUBJECTS OF THIS COMPREHENSIVE STUDY ILLUSTRATED WITH ACTUAL CASES.
Abstract: ADDRESSED TO AN AUDIENCE OF CRIMINOLOGISTS AND LEGAL EXPERTS, THIS BOOK FOCUSES ON IDENTIFYING THOSE PARTS OF THE AUSTRALIAN CRIMINAL CODE AND OTHER PIECES OF LEGISLATION WHICH DEAL SPECIFICALLY WITH THE SENTENCING OF DEFENDANTS CONVICTED OF INDICTABLE OFFENSES. A SECTION OF THE BOOK LISTS VARIOUS KINDS OF PENAL SANCTIONS THAT MAY BE INFLICTED UNDER THE CRIMINAL CODE OF QUEENSLAND SUCH AS IMPRISONMENT WITH AND WITHOUT HARD LABOR; DETENTION IN A REFORMATORY PRISON, INDUSTRIAL, OR REFORMATORY SCHOOL; DETENTION IN OTHER CORRECTIONAL INSTITUTIONS AS SPECIFIED BY THE 1965 AUSTRALIAN CHILDREN'S SERVICES ACT; SOLITARY CONFINEMENT; WHIPPING; FINES; AND FINDING SECURITY TO KEEP THE PEACE AND BE OF GOOD BEHAVIOR. QUEENSLAND HAS NO DEATH PENALTY. ONE OF THE BOOK'S MAIN PURPOSES IS TO INFORM CRIMINAL JUSTICE MAGISTRATES OF ALL THE SENTENCING OPTIONS AVAILABLE TO THEM UNDER ANY GIVEN SET OF CIRCUMSTANCES. THE BOOK COVERS NONCUSTODIAL AND CUSTODIAL SENTENCES (FOR ADULTS AND JUVENILE OFFENDERS), AND ADDITIONAL ORDERS (E.G., ORDERS FOR INJURY COMPENSATION, FOR RESTITUTION OF PROPERTY, AND DISQUALIFICATION FROM DRIVING). ALSO DISCUSSED ARE MATTERS AFFECTING THE DETERMINATION OF A SENTENCE (E.G., OFFENDERS' PERSONAL AND CRIMINAL HISTORIES, EXTENUATING AND AGGRAVATING CIRCUMSTANCES, OFFENDERS' PHYSICAL HANDICAPS, AND RECIDIVISM OF OFFENDERS). APPEALS AGAINST SENTENCES BY THE ATTORNEY GENERAL ARE GIVEN AS ARE SENTENCE RANGES FOR MOTORING AND DRUG OFFENSES, CRIMES AGAINST PERSONS, SEXUAL OFFENSES, CRIMES AGAINST PROPERTY, AND ARSON AND MALICIOUS DAMAGE. TABLES OF CASES AND STATUTES PRECEDE THE TEXT, AND A SUBJECT INDEX IS APPENDED.
