SENIOR LAW STUDENTS ARE ALLOWED TO TRY MINOR CRIMINAL CASES UNDER THE SUPERVISION OF DULY APPOINTED PROSECUTORS.
Abstract
MASSACHUSETTS IS THE FIRST JURISDICTION TO PERMIT LAW STUDENTS TO PROSECUTE MINOR CRIMINAL CASES- BOTH NON-JURY AND SIX-MAN JURY, UNDER THE SUPERVISION OF ASSISTANT DISTRICT ATTORNEYS. THE PROJECT SOUGHT TO DEVELOP COOPERATION BETWEEN THE LAW SCHOOLS AND THE LAW ENFORCEMENT AGENCIES, AND TO TRAIN MORE LAW STUDENTS AS PROSECUTORS TO COPE WITH THE INCREASING NUMBER OF CRIMINAL TRIALS AND APPEALS (DUE TO WIDESPREAD AVAILABILITY OF DEFENSE COUNSEL FOR INDIGENTS). THE SUPREME JUDICIAL COURT OF MASSACHUSETTS AUTHORIZED THE STUDENTS TO APPEAR ON BEHALF OF THE COMMONWEALTH IN CRIMINAL CASES IN MASSACHUSETTS DISTRICT COURTS.
