THE TAPED PROCEEDINGS OF A CONFERENCE WORKSHOP IN WHICH THE SPEAKER REVIEWS THE BACKGROUND AND PHILOSOPHY OF THE JUVENILE JUSTICE SYSTEM AND EXAMINES THE DEVELOPMENTS IN JUVENILE CODES AND CASE LAW.
Abstract
THE HISTORY OF JUVENILE LAW IS BRIEFLY EXAMINED. THE SPEAKER THEN PROVIDES AN OVERVIEW OF A WIDE RANGE OF ISSUES IN JUVENILE JUSTICE AND JUVENILE LAW, NOTING THE EVOLUTION OF THIS LAW FROM THE PARENS PATRIAE PHILOSOPHY TO THE CURRENT TREND IN EXTENDING CONSTITUTIONAL PROTECTIONS TO JUVENILES. AMONG THE SPECIFIC TOPICS EXAMINED ARE THE CONFIDENTIALITY OF JUVENILE RECORDS, THE ARREST OF JUVENILE OFFENDERS, SEARCH AND SEIZURE IN JUVENILE CASES, AND LINEUPS. SEVERAL ISSUES OF JUVENILE LAW ARE EXAMINED WITHIN THE SCHOOL CONTEXT, INCLUDING SEARCH OF STUDENTS' LOCKERS BY SCHOOL ADMINISTRATORS, SUSPENSION OF STUDENTS, AND CONFESSIONS GIVEN BEFORE SCHOOL OFFICIALS. STANDARD INTAKE PROCEDURES FOR THE JUVENILE COURT ARE OUTLINED AS WELL. FINALLY, THE SPEAKER PROVIDES A BRIEF REVIEW OF THE IMPLICATIONS OF THE MAJOR U.S. SUPREME COURT DECISIONS DEALING WITH JUVENILES. ALSO INCLUDED IN THIS RECORDING ARE A QUESTION AND ANSWER PERIOD AND A BRIEF SMALL GROUP EXERCISE BY CONFERENCE PARTICIPANTS.
