PROVISIONS OF THE STANDARDS ON NONCRIMINAL BEHAVIOR PROPOSED BY THE INSTITUTE OF JUDICIAL ADMINISTRATION AND AMERICAN BAR ASSOCIATION JOINT COMMISSION ON JUVENILE JUSTICE STANDARDS ARE SUMMARIZED.
Abstract
THE STANDARDS RECOMMEND THE ELIMINATION OF STATUS OFFENSES FROM JUVENILE COURT JURISDICTION, STATING THAT 'ACTS OF MISBEHAVIOR, UNGOVERNABILITY, OR UNRULINESS WHICH DO NOT VIOLATE THE CRIMINAL LAW' SHOULD NOT FALL WITHIN THE JUVENILE COURT'S JURISDICTION. THIS STANDARD IS NOT INTENDED TO PRECLUDE JUDICIAL APPROVAL OF ALTERNATIVE RESIDENTIAL PLACEMENT FOR JUVENILES IN FAMILY CONFLICT, PROCEEDINGS FOR THE MENTAL HEALTH COMMITMENT OF A JUVENILE, PROCEEDINGS IN CHILD NEGLECT OR ABUSE, OR PROCEEDINGS IN DELINQUENCY. OTHER SECTIONS OF THE STANDARDS DELINEATE PRINCIPLES AND GUIDELINES TO BE OBSERVED BY LAW ENFORCEMENT AGENCIES IN PLACING JUVENILES UNDER TEMPORARY DETENTION AND IN DEALING WITH RUNAWAY JUVENILES. THE STANDARDS ALSO RECOMMEND A BROAD SPECTRUM OF SERVICES TO BE PROVIDED, ON A VOLUNTARY BASIS, TO ASSIST JUVENILES IN RESOLVING CONFLICTS WITH THEIR FAMILIES. OTHER SECTIONS OFFER GUIDELINES FOR THE ALTERNATIVE RESIDENTIAL PLACEMENT OF JUVENILES IN FAMILY CONFLICT AND FOR THE PROVISION OF EMERGENCY SERVICES FOR JUVENILES IN CRISIS.
