  Annotation: Prepared as part of the Bureau of Justice Statistics Firearm Inquiry Statistics (FIST) Project, this report describes procedures related to presale firearm background checks in each of the 50 States at the end of 1996.
  Abstract: The FIST Project was established in 1995 to collect data on the impact of presale firearm checks required under Federal and State laws. In addition, interim provisions of the Brady Handgun Violence Prevention Act prohibit the sale of handguns by Federal firearm licensees for a period of 5 days or until licensees are advised, based on a background check, they are not prohibited from purchasing handguns. After November 1998, when permanent provisions of the Brady Act become effective, instant background checks will be required prior to the sale of any firearm by a licensee. Procedural information is provided to give readers a more complete understanding of the impact of presale firearm background check requirements. Data are compiled from State agencies authorized to perform background checks for handgun purchasers and to determine if applications are acceptable under the Brady Act. Procedures applicable to handguns and other firearms are described. The following types of information are provided for each State: source of information, restrictions on purchases, limitations on use, permits, handgun registration, scope of sales covered, background checks, information on the application, inquiry process, fees charged, State data, retention of applications, and statistics maintained. Supplemental information on State FIST contacts and State summary tables are appended.
