This volume offers a comprehensive selection of court decisions affecting prison law, with attention to sentencing, limits on State powers, prisoners' rights, parole, and civil rights.
Abstract
Cases cited in the sentencing section address improperly based commitments, the right to suspend a sentence, imprisonment as a sanction for not paying a fine, mandatory sentences, correcting unequal or excessive sentences, extending commitments for treatment or dangerousness, and changing minimum terms of parole eligibility. Among the topics discussed in the State powers chapter are disciplinary punishment, imposed therapy, prison labor, and prisoner transfers. Other cases focus on prisoners' rights, including rights relating to legal proceedings, religious matters, contacts with the outside world, health care, sex and marriage, property, and physical self. Cases dealing with parole consider parole boards' legality, granting parole and its conditions, supervision, good time, conditional release, work release, and detainers. The cases presented under civil rights relate to restrictions on licenses, property rights, and legal rights of ex-offenders.
