The Czechoslovak Code of Penal Procedure provides that the victim shall be given the opportunity to be an active party in criminal proceedings and have the possibility to claim compensation for damages suffered as a consequence of the crime.
Abstract
Under the Code's provisions, the victim ('the aggrieved') is any person whose health has been injured or who has suffered property, moral, or other damages as a result of crime. The Code also provides the victim with the right to bring motions, access files, attend trial, question persons being examined, be represented by an attorney, and attend appeal proceedings. In addition, the prosecutor may move the court on behalf of the victim in cases when the aggrieved has not asked for compensation. The present Code can be improved by guaranteeing the rights of the victim at all stages of the penal proceedings by safeguarding these rights in cases where penal proceedings are suspended.
