This handbook provides an overview of Minnesota juvenile court practice in the areas of juvenile delinquency, dependency and neglect, custody, and related matters.
Abstract
The philosophy of the juvenile court is reviewed, and terminology and rules of procedure are defined. In the area of delinquency, procedures, goals, and relevant rules, statutes, and case law are examined with respect to rights of minors, petition and notice, the guardian ad litem, arraignment, discovery, pretrial procedures and motions, the trial itself, and postrial proceedings and appeal. Detention hearing and review are discussed, and identification procedures during detention are outlined. Disposition hearing procedures, review, and alternatives also are examined. Neglect and dependency matters considered include the attorney's role, immediate custody, and prehearing placement and procedures for discovery, disposition, and private petitions. The goals and effects of termination of parental rights are delineated, and the attorney's role in settlement options is discussed. Other matters covered include the use of juvenile court records, juvenile traffic offenders, status offenses, and the mentally ill. Rules of procedure and statutes are appended.
