A lawyer reviews all the Federal, State, and local laws that are potentially applicable to AIDS in the workplace; analyzes specific issues related to AIDS; and recommends courses of action that are both consistent with legal cases and protective of legitimate business interests.
Abstract
A discussion of generation considerations emphasizes the need for educating workers about AIDS and outlines medical facts; social, ethical, and legal considerations; business concerns; and health care considerations. Laws, court decisions, and pending cases are examined in terms of their relevance to AIDS situations. Testing for AIDS is discussed in terms of the types of tests, arguments for and against testing, one company's testing policy, and methods of implementing testing policies. Guidelines on practical approaches include a framework for analyzing problems, requirements for medical insurance coverage for terminated employees, the testing of applicants or employees for antibodies to the AIDS virus, and methods of dealing with an applicant or employee who has AIDS. Further advice covers the determination of whether an employee with AIDS can perform the job, written policies on AIDS problems, the prevention of AIDS-related claims, and employer defenses against AIDS-related claims. Index and appended sample documents, resources, legal pleadings, court decision texts, checklists, and related materials.
