Each State should examine its legislation regarding correctional personnel assignments to determine whether changes are needed to authorize the use of modern systems of personnel deployment being used in police organizations, hospital nursing staffs, banking, and airline reservation systems.
Abstract
These organizations have developed sophisticated deployment systems for shift workers to improve service delivery and cost performance. Nearly all these deployment systems involve variations of permanent shifts and post, in which one person works the same shift and post continuously, or rotating shifts and posts. These systems sometimes involve a system of bidding for posts. The laws of more than half the states currently reserve the personnel deployment power to the department of corrections. The states which do not place the power to make post assignments in the department of corrections are often the ones that have complete post bidding systems, however, as the lack of statutory reservation has paved the way for post bidding. States with only general language may need more definitive legislation to give some assignment authority back to the correctional department. States that have bargained away the statutory authority may also need corrective legislation. 117 footnotes.
