The author describes crimes against businesses by insiders as an insidious and growing problem, causing annual losses of more than $100 billion. He argues that the polygraph process is a significant tool that can prove valuable in both the screening and investigative processes, and that States, not the Federal Government, should regulate their use. Existing State and local laws and regulations, as well as judicial oversight, are adequate safeguards to insure the rights of employees and prospective employees. He cites State court rulings that uphold the position that, when properly administered, polygraph examinations are lawful, and maintains that the majority of States have taken steps to ensure that polygraphs are used lawfully. 24 footnotes.
