The sentencing forms in this appendix were developed to assist judges in imposing sentences under the Sentencing Reform Act of 1984.
Abstract
Forms 1 through 8 are adult sentencing modules that are to be combined to formulate a sentence. Most sentences will begin with Form 1 (imprisonment and supervised release) or Form 2 (probation) and will include one or more additional forms including conditions of probation or supervised release, restitution, fine with special assessment, order of notice to victims, special assessment without fine, and voluntary surrender to marshal. Forms 9 through 11 are for dispositions involving deferral of judgment on conviction for simple possession of controlled substances. These include probation without judgment, dismissal of case upon successful completion of probation without judgment, and expungement of official records of certain youthful drug offenders. Form 12 covers disposition of juvenile delinquents; and Form 13 deals with commitment for care or treatment of mental disease or defect. The forms are introduced by the statement that the disposition is pursuant to the Sentencing Reform Act. Of necessity some of the language in the forms is illustrative and modifications may be needed to fit individual cases, particularly those involving multiple counts. In some forms, alternative workings are provided. Explanatory notes for the forms also are included.
