This technical report presents 19 standards intended to guide those responsible for developing legislation and regulations regarding the security, privacy, and confidentiality of criminal history information.
Abstract
New standards have been added to address the growing concern with noncriminal justice access to criminal history records and the establishment of the Interstate Identification Index. The extensive commentary accompanying each standard aids the reader in understanding underlying policies and implications of the standard. The revised standards reflect several goals either not addressed in the original standards or considered of less importance than currently warranted. One of the goals is that the States should have exclusive control over criminal history information that they create or receive and that noncriminal justice agencies may have a legitimate need for access to criminal history information. Another goal is that, insofar as is possible, all criminal history information should be disseminated only on the basis of positive identification by means of fingerprints. The standards also encourage State and local agencies to implement safeguards to enhance the security of manual and automated criminal justice information systems. The standards encourage improved record programs, training, user fees, auditing, and participation in the Interstate Identification Index, which provides for the interstate exchange of criminal record history information. 11 annotated related reading materials.
