Missouri's AIDS legislation, enacted in 1988, marks a significant advance in the State's effort to contain the AIDS epidemic and clearly addresses AIDS as a public health crisis.
Abstract
The legislation incorporates legal and social concerns, as well as public health measures. It encompasses the regulation of laboratories that conduct HIV testing, the importance of counseling in the HIV testing process, the protection of confidentiality, antidiscrimination, and education. The legislation also addresses the issue of insurance, including insurance policy coverage and the accuracy of insurance company laboratory testing, and the management of noncompliant individuals. Missouri's legislation gives the Department of Health authority to promulgate rules for testing individuals who apply for marriage licenses when scientific evidence indicates the need for such testing. Further, the legislation covers anonymous AIDS testing, partner notification for those who test positive at anonymous test sites, and care coordination. 44 references.
