This discussion focuses on the statutory and case law relating to the degree to which the constitutional rights afforded adults are also available to children and at what time the adult legal status for self-determination can be claimed by minors.
Abstract
The information is intended for use by attorneys who are representing children and youth. A discussion of rights based on age explains restrictions on the privacy right resulting from the inability to consent and restrictions on rights to take part in activities related to religion, physical mobility, alcohol and tobacco, and access to sexually explicit materials. An analysis of the minor's right to contract focuses on voidable contracts, binding contracts, employment, estates, and ownership of real property. Additional sections cover the minor's and parent's liability for tortious acts by the minor, the development of legal doctrines related to emancipation, the purposes of emancipation, filing procedures related to emancipation, the rescission of the emancipation decree, and the principles and procedures related to guardianships.
