Texas law prohibits routine mandatory testing for HIV infection. Information related to testing is also confidential. Both civil and criminal penalties may be imposed for violations of the testing and confidentiality provisions. All probation departments are encouraged to develop policies providing for continued employment of employees who test positive for HIV and to provide ongoing HIV education and training for all staff and probationers. Departments should maintain a safe work environment, recognizing that staff are rarely exposed to situations where viral transmission is possible. However, staff should assume that every probationer or area to be searched may possess a sharp object that is potentially infectious and should follow specific steps for cleaning and decontamination. The guidelines are intended for use as technical assistance and are not linked to the distribution of State aid.
