This document delineates the conclusions that the British Government has reached concerning the future arrangements for prison discipline in England and Wales.
Abstract
The conclusions reached include: (1) the disciplinary role and powers of prison governors should remain unchanged; (2) the code of disciplinary offenses should be accepted; (3) the Boards of Visitors should lose their disciplinary functions; (4) the more serious prison disciplinary offenses should be dealt with by local panels of adjudicators forming a single new Prison Disciplinary Tribunal; and (5) penalties for disciplinary offenses should be revised. Also, there should be a right of appeal to the local panels of the new Prison Disciplinary Tribunal from governors' decisions where more than 14 days' forfeiture of remission have been awarded; and prisoners should continue to be able to petition the Secretary of State about any adjudication. Finally, there should be no automatic right to legal representation in hearings before the Tribunal. Appendix.
