Because the clandestine manufacture of drugs and supply routes for precursor chemicals cross State boundaries, all States must monitor their chemical suppliers. Chemicals reach illicit operations through either unwitting action or knowing and intentional action by chemical supply firms. The model act is intended to eliminate the unwitting supply through registration and proof of identity and to establish clearcut evidence against suppliers who continue to knowingly and intentionally furnish chemicals to drug traffickers. The degree of monitoring and control necessary and feasible will vary from State to State, depending on the scope of chemical suppliers and on the clandestine production problem within a State. The model act takes the form of suggested amendments to the Uniform Controlled Substances Act. The suggested amendments concern registration requirements, records and reporting requirements, inspection authority, subpoena, civil forfeiture, offenses, and penalties.
